Article I
NAME
The name of this organization shall be Snohomish County Basketball
Officials Association, hereinafter referred to as S.C.B.O.A.
Article II
PURPOSE
The S.C.B.O.A. shall further the best interests of athletics by:
Section 1.
Being sanctioned by the WIAA to provide registered basketball
officials to schools of Snohomish, King, and Island Counties.
Section 2.
Promoting uniformity in the interpretation of the rules and
mechanics of the game, for players, coaches, and officials.
Section 3.
Encouraging observance of the spirit and letter of playing rules and
ethical codes on all occasions.
Article III
MEMBERSHIP
Section 1.
Any person desiring membership must present his or her application
with the stipulated fee to the assigning secretary of the
association. Board approval is required for all membership
applications.
Section 2.
Apprenticeship
A.
All new members of the S.C.B.O.A., who have not previously
served at least two years as a WOA basketball official, will serve
at least a two year apprenticeship.
B.
During the apprenticeship period, all apprentices will attend
all scheduled apprentice meetings in addition to the general
meetings.
C.
Apprentices may be assigned a mentor official for the
purposes of training and answering questions or concerns related to
the S.C.B.O.A.
D.
After the two-year apprenticeship, the executive board will
determine if the official will serve another year as an apprentice
or approve the official to take the state test closed book and
become a certified official. Should the official fail to pass the
state test, they will automatically serve another year as an
apprentice official.
E.
Apprentices may be assigned varsity games only under the
direction of the executive board.
Section 3.
Qualifications for registered membership:
A.
Current registration with WOA.
Section 4.
Qualifications for certified membership:
A. Officials must attend an annual sanctioned WIAA officiating
rules clinic in that sport.
B. Officials must pass the current state test in that sport
with a score of 70%.
C. Officials must attend 75% of the scheduled meetings.
Section 5.
Officials must have board approval and meet the requirements in
section 4 above, to be assigned varsity and/or post season
assignments.
Section 6.
Any member who is assigned to officiate by the assigning secretary
shall be counted present at meetings if the game is at the time of
the meeting.
Section 7.
Meetings may be made up by:
A. Attending the apprentice meetings.
B. Attending board approved activities.
Article IV
TRANSFERS
Section 1.
The board shall accept into full membership any official who is a
transfer from another association, provided the official is also a
member in good standing of the WOA. The official who is transferring
must present written evidence of prior membership from his/her
former local secretary. The assigning secretary shall confirm prior
membership and standings.
Section 2.
No transfer will be final until an official’s membership transfer
form has been filed in the WOA office.
Section 3.
Officials transferring into the association shall be evaluated and
have their initial rating determined by the executive board. The
number of games and level of games that a transferring official may
receive shall be determined by the board.
Section 4.
Transferring officials shall not be eligible for post-season
assignments during their first year with S.C.B.O.A.
Section 5.
Transferring officials shall not be eligible to rate during their
first year with S.C.B.O.A.
Article V
MEETINGS
Section 1.
General Meetings:
A.
There shall be a minimum of six general meetings as
determined by state requirements.
B.
The president of the association shall call the first meeting
of the year, which shall be a minimum of 4 weeks prior to the
beginning of varsity game assignments.
C.
The remaining meeting dates are to be set by the president
and confirmed by the executive board.
D.
Meeting agendas shall be determined by the president with the
following inclusions;
Meeting 5: Nominations for officers.
Meeting 6: Nominations for officers.
Meeting 7: Elections and awards.
E.
At all general meetings of the association, 1/3 of the
general membership, in person, shall constitute a quorum of which a
simple majority vote is required for approval of business.
Section 2.
Executive Board Meetings:
A. A joint board meeting of outgoing and incoming board
members shall be called in April by the outgoing president.
B.
Subsequent executive board meetings shall be called at the
discretion and direction of the president or at the request of any
three board members.
C.
At
all meetings of the executive board, a majority of the voting
members of the executive board, including the president or vice
president, shall be necessary and sufficient to constitute a quorum
for the transaction of business.
Section 3.
Roberts Rules of Order shall be observed and shall govern all
membership and executive board meetings.
Article VI
FINANCE
Section 1.
The annual dues for each member shall be determined by the executive
board and shall consist of local and state fees.
Section 2.
No registrations will be accepted after December 31, for the
basketball season.
Section 3.
Dues are subtracted from each member’s pay each year for the
following year.
Section 4.
Members resigning at the end of the season from S.C.B.O.A. shall be
reimbursed for any dues subtracted for the following year.
Section 5.
The board shall assess a fee for all assignments. The amount of
which shall not exceed 5% of the member’s game fees.
Section 6.
Special assessments shall be permitted by board decision.
Section 7.
The assigning secretary will submit a preliminary budget to the
board prior to the start of the season. Upon acceptance, the board
must approve all additional expenditures.
Article VII
FEES AND MILEAGE
Section 1.
When two schools from different classifications meet in a non-league
game, the fee of the home school shall be paid.
Section 2.
All contest fees are established by the WIAA Executive Board, and
are listed in the Washington Officials Association Manual.
Section 3.
The executive board or their designee shall negotiate all other
fees, such as administration, mileage, etc.
Article VIII
FINES
Section 1.
An official who cancels a game assignment after accepting it may be
fined $5.00 per canceled assignment.
Section 2.
An official who cancels a game assignment less than 24 hours before
game time shall be assessed a fine of $10.00 per canceled
assignment.
Section 3.
An official who misses a game assignment shall be fined the amount
of the game fee.
Section 4.
An official who misses his/her second game assignments will be fined
twice the amount of the game fee and must appear before the board
before they will be assigned any additional games.
Section 5.
An official who works a game alone will receive double the game fee
provided that the officials had made prior contact confirming the
assignment.
Section 6.
An official who cancels an assignment after accepting it or misses
an assignment must within 10 days contact the assigning secretary
with an explanation for the missed or canceled assignment.
Section 7.
Rating sheets for all JV and varsity game assignments must be turned
in at the first general meeting following the assignments. Officials
not able to attend the meeting may mail the rating sheets to the
assigning secretary, postmarked no later than the day of the
meeting. Fines for late rating sheets will be $5.00 per rating.
Section 8.
An official who fails to turn in their pay sheet and final rating
sheets before March 1 may be assessed a fine of 10% of their game
fees.
Section 9.
Officials who are assigned to a varsity game and are not able to
attend at least 2 quarters of the JV game (one which must be in the
first half) and therefore are unable to rate the JV official will
forfeit their mileage for this game.
Section 10.
Officials who are assigned to a JV game must attend 2 quarters of
the varsity game. Officials who do not fulfill this requirement will
forfeit their mileage for this game.
Section 11.
The executive board shall review and oversee all fines.
Article IX
UNIFORMS
Section 1.
Officials shall wear the uniform as described in the current
rulebook including the WOA State patch.
Section 2.
Officials will wear the V neck shirt for all JV and varsity game
assignments.
Article X
GRIEVANCE POLICY
Section 1.
The executive board has the authority to remove any official from
the association for immoral conduct, unethical practice, violation
of the code of ethics, or behavior deemed detrimental to the
S.C.B.O.A.
Section 2.
Charges of unethical behavior or misconduct must be submitted in
writing and postmarked within seven days of the incident or
knowledge of the incident to the president of the executive board.
The president may appoint an ethics committee chairperson to form a
committee if necessary to review the incident.
Section 3.
Any member removed from officiating shall be notified of his/her
ineligibility by the president in a timely matter. Notice to the
accused shall either be by certified mail or by delivering said
notice in person. Such notice shall include:
A.
The specific reasons for the alleged ineligibility and the
rule being violated.
B.
Advise the official of his/her opportunity to request a
hearing at the local level in order to contest the reason(s) for or
the allegation(s) of such alleged ineligibility.
C.
A statement that a written petition for a hearing must be
postmarked or received by the assigning secretary, on or before the
expiration of the seventh calendar day after notification of
ineligibility.
D.
The rights of the accused during the course of the hearing
Section 5.
The accused member shall have the right at a hearing to:
A.
Explain the circumstances of the alleged violation(s)
B.
Present evidence and witnesses to support the member’s
position
C.
Present evidence to mitigate possible disciplinary action;
Section 6.
It shall be the duty of the president to appoint any member of
S.C.B.O.A. to present the evidence at the hearing.
Section 7.
The executive board shall review the evidence and shall issue a
decision within seven days of the hearing date. The decision shall
be by a majority vote of the board. The president shall notify the
accused either by certified mail or by delivering said notice in
person. The decision shall outline the evidence supporting the
decision. If the decision involves suspension, expulsion, probation
or regulation of assignments, the notice shall include the length of
such and the effect such discipline has on their membership
standing.
Section 8.
The executive board guarantees due process to any official wishing
to appeal a disciplinary decision. The official is guaranteed the
right to a hearing before the board at the next executive board
meeting. When an appeal of an executive board decision is made, an
appeal board will be established consisting of five members from the
general membership and heard within a reasonable time of the
incident. The appeal must be made in writing, must state reasons why
the executive board decision is in error, and must be received by
the president within seven days of the executive board decision.
Failure to do so will waive the right of appeal.
Section 9.
Refer to Washington Officials Manual, Article VII, Section 2, titled
“Regional Procedures”.
Section 10.
Refer to Washington Officials Manual, Article VII, Section 3, titled
“State Procedures”.
Section 11.
Misconduct can be charged for but is not limited to the following:
1.
Using abusive language.
2.
Degrading fellow S.C.B.O.A. members.
3.
Providing unwarranted, derogatory news media releases and/or
interviews.
4.
Using distasteful gestures.
5.
Using mood-altering substances the day of the game that could
substantially impair
judgement (i.e. alcohol,
drugs, or even certain prescription drugs).
6.
Undercutting the established WIAA/WOA officials contest fee.
7.
Failing to show up for a contest assignment previously
accepted.
8.
Violating any section of the S.C.B.O.A. Constitution.
9.
Intentionally deviating from enforcement of WIAA approved
rules.
10.
Failing to wear the proper WOA uniform.
11.
Being charged with a felony criminal act or a misdemeanor
act involving use or
distribution of mind or body
altering drugs, theft or acts involving moral turpitude
(Emergency suspension before
the hearing is permissible if serious charges warrant it).
12.
Being convicted of a criminal act.
13.
Requesting to officiate a specific game from any coach,
league, or administrative
official thereof.
14.
Obligating themselves to any person affiliated with any
contest they might be
assigned to officiate.
Article XI
LEAVE OF ABSENCE
Section 1.
A member who requests a leave of absence must submit the request in
writing to the president of the executive board. This leave will
entitle the official to retain his place on the ratings list for one
year.
Article XII
OFFICERS
Section 1.
President
A.
Shall preside as chairman of the executive board and shall
conduct all general and executive board meetings.
B.
Shall distribute agendas for executive board meetings.
C.
Shall act as a representative of this organization on
correspondence and communication with other organizations.
D.
Shall assume duties as deemed necessary by the executive
board.
E.
Shall appoint committee chairpersons as deemed necessary and
as approved by the executive board.
F.
The office of the president shall be filled by the vice
president of the previous year.
G.
Should
the vice president be unable, or unwilling to fill the position of
president, an appointee of the executive board may function as
president until a valid election can be held.
Section 2.
Vice President
A.
Shall assume all duties of the president if the president is
unable to fulfill them.
B.
Shall assume duties as deemed necessary by the executive
board.
C.
Shall act as chairman of the apprentice committee.
Article XIII
EXECUTIVE BOARD
Section 1.
There shall be six members of the executive board whose
qualifications, election and term of office are as follows:
A.
To be elected to the board, a member must be in good standing
and must remain so during the period of his/her term of office.
B.
Members of the executive board are president, vice-president
and past -president. Each year a new vice-president shall be elected
and serve one year as vice-president, then the next year as
president, and then the third year as the past-president.
C.
There shall also be three at large representatives elected
for a period of three years. One member shall be elected each year
as the representative in his/her third year retires.
1. The
representative in his/her first year shall be a member of the
association, and shall act as recording secretary. He/she shall have
the authority to appoint any committees necessary to fulfill the
duties as the president or executive board may direct. Term: First
year of a three- year term.
2. The
representative in his/her second year shall be a member of the
association, and shall act as chairman of the education committee.
He shall have the authority to appoint any committees as necessary
in the fulfillment of this position and shall perform other such
duties as the president or executive board may direct. Term: Second
year of a three- year term.
3. The
representative in his/her third year shall be a member of the
association; shall be the senior member of the representatives, and
shall act as chairman of the elections committee. He shall have
authority to appoint any committees as necessary in the fulfillment
of his position, and shall perform such other duties as may be
directed by the president or executive board. Term: Third year of a
three-year term.
D.
The past president of the association shall be a voting
member of the executive board, shall act as liaison with the women’s
executive board, and shall perform such other duties as the
president or executive board may direct. In the event the past
president is unavailable to fill the position of past president,
his/her predecessors, in reverse order, shall assume this position.
E.
The assigning secretary shall be appointed by the executive
board and shall be a non-voting member of the executive board whose
presence will be required at all general and executive board
meetings.
1.
Appointment of the assigning secretary shall be effective
July 1 and contingent upon annual review.
2.
Applications shall be submitted to the executive board by May
1 to be considered.
3.
Term of the appointment shall be one year with renewable
options.
F. Duties of the assigning secretary shall include:
1.
Maintain the status of all officials, including their
addresses, phone numbers, and ratings.
2.
Maintain the attendance records for all general and executive
board meetings.
3.
Be responsible for the safeguarding and the disbursement of
the monies as designated by the executive board.
4.
Prepare and keep annual financial statements.
5.
Distribute contracts to the leagues.
6.
Assign officials to fulfill game commitments in compliance
with board policy.
7.
Meet with league representatives to review policies and
procedures.
8.
Shall be compensated according to the decision of the
executive board each year.
9.
Shall have the books audited during the month of June, by an
auditor selected by the executive board.
10.
Assume duties as deemed necessary by the executive board.
Section 2.
The executive board shall act as the governing body of this
organization.
Section 3.
The president shall not have a vote at the board of directors
meetings unless a tie should occur. The president shall then be
allowed to cast the deciding vote.
Section 4.
The executive board shall review all petitions and proposals.
Section 5.
The executive board shall review and approve all evaluations and
ratings.
Section 6.
The executive board is empowered to discipline members by fining,
suspension, probation, and expulsion. An ethics committee may be
formed to aid in any disciplinary actions: With the final decision
resting with the executive board. Members are guaranteed due process
to appeal.
Section 7.
Any officer or executive board member may be recalled through a
petition stating reasonable cause and signed by 66% of the active
membership followed by a referendum ballot.
Article XIV
ELECTIONS
Section 1.
Process:
The president
shall appoint the senior representative as chair of the elections
committee. The elections committee shall propose a slate for
election to the association on the 5th meeting of the
year. Additional nominations may be presented through the close of
the 6th meeting of the year. No nominations may be
allowed after the 6th meeting of the year. The elections
shall take place during the 7th meeting of the year.
Section 2.
Voting:
A. The elections committee shall be responsible for giving
each member of the association present, a ballot listing all persons
nominated for board positions and instructions to cast a vote for
each of the board positions being elected. Any ballot with more
votes than board positions shall be disqualified. The president and
two others appointed by the president shall count the ballots. The
individuals receiving the most votes shall be declared the winners.
In the event of a tie for one position, another vote shall be taken
to determine the winner from the persons who had tied.
B.
Absentee ballots will be mailed those members of the
association in good standing, who meet the following requirements:
1.
Requests must be made to the assigning secretary no later
than 10 days before a scheduled election or referendum ballot.
2.
Absentee ballots must be received no later than the day of
the election or referendum ballot to be valid.
3.
Members requesting an absentee ballot must have been in
attendance for one of the nominations meetings, or in the case of
the referendum ballot, the previous meeting where the ballot was
introduced and discussed.
Article
XV
C OMMITTEES
Section 1.
Committee chairpersons will be appointed by the president and
approved by the executive board, as deemed necessary, for a term of
one year.
Section 2.
Chairpersons shall select members for their committees.
Section 3.
The following committees shall be appointed each year:

By-laws/handbook
B.
Elections
C.
Awards/banquet
D.
Education
E.
Apprentice
F.
Recruitment
G.
Golf tournament
H.
Ratings/evaluations
Article
XVI
RATINGS OF OFFICIALS
Section 1.
Ratings will be filled out on designated rating forms.
Section 2.
All certified officials will fill out ratings. All varsity and
junior varsity games are to be rated.
Section 3.
For your rating to count, you must attend 2 full quarters of the
game.
Section 4.
If not in attendance for required quarters of the game, the rating
form shall still be turned in. The reason for not rating will be
written across the top of the form. (Comments will still be applied
for portion of the game attended).
Section 5.
Numerical rating will be applied consistently by using supplied
descriptors as a resource.
Section 6.
All marks of 7 or less require specific comments. Those who fail to
make appropriate comment could be asked to come before the board to
give an explanation.
Section 7.
Any rating which is 8 or more points below that individual’s current
year’s rating will be monitored by the board, who could possibly
call in the evaluator for justification to ensure that the comments
support the rating.
Section 8.
On the current rating form, .5(1/2) points will be allowed.
Section 9.
All rating forms shall be turned in at the next meeting following
the game being rated. If not in attendance at that meeting, your
rating shall be mailed to the assigning secretary with a postmark by
no later than that meeting. A $5.00 fine will be assessed for each
late rating.
Section 10.
Officials will place all pink slips belonging to the rated official,
in their designated folders. Officials receiving ratings should pick
them up at every meeting in their designated folder.
Section 11.
The executive board shall have final authority on all ratings and
may elect to delete ratings that do not meet the above criteria from
official’s scores.
Article XVII
TOURNAMENT SELECTIONS
Section 1.
The assigning secretary, as directed by the board, shall submit a
list of the top fifteen rated certified officials from the current
year’s ratings, who meet the following criteria:
A. Officials must have a minimum of ten varsity
assignments in the present season.
B. Officials
must have attended at least 75% of the meetings from the previous
season or take and successfully pass the WIAA approved test.
C.
Officials must have attended a WOA Rules Clinic for the
present season.
Section 2.
Any official who works in two consecutive state tournaments will
take a one year leave and allow the next highest rated official the
opportunity to go to a state tournament. The rating will be based on
the previous year placement, and that official will have had to
officiate that season.
Article XVIII
AMENDMENTS OR REVISIONS
Section 1.
Referendum Ballot:
A. A referendum ballot shall be secret and the right to
vote in a referendum shall be open to all members in good standing
of this association. No issue shall go to referendum ballot without
first being introduced and passed on the floor.
B. Amendments to these laws, petitions of recall of
executive board members, or any issue specifically requested by a
majority vote of the members voting on the floor shall go to
referendum.
Section 2.
By the Membership:
The power to
make, amend, or repeal by-laws may be adopted at any membership
meeting, or any special meeting of the membership called for that
purpose, by a referendum ballot representing a 2/3 majority vote of
the membership present providing a quorum is present.
Article XIX
DISSOLUTION
Section 1.
In the event of dissolution of this organization, any funds
remaining after payment of all expenses will be applied to the
benefit of amateur athletics in Snohomish County, as deemed by the
general membership. |
